Department of Health & Mental Hygiene

   WHAT WE DO:

Regulations

This office manages and coordinates all aspects of the process of adopting new, amending, or repealing regulations for the Department of Health and Mental Hygiene (DHMH).

The Department's regulatory process is governed by the:
1)  Administrative Procedures Act under State Government Article, §§10-101 - 10-139, Annotated Code of Maryland;
2) State Documents Law under State-Government Article, §§7-101 - 7-222, Annotated Code of Maryland;
3) COMAR 10.01.07 Petitions for Adoption, Amendment or Repeal of Regulations
4)  DHMH Policy 02.10.01 Policy For Regulations
5)  DHMH Procedures 02.10.01.P1 - Procedure For Regulations  .

Policies

This office manages and coordinates all aspects of the Department's internal policy process.

The Department's policy program is under the authority of State Government Article §2-102,  Annotated Code of Maryland and DHMH Policy 02.10.03 DHMH Policy On Policies.

Board of Review

This office provides staff support for the Board of Review, which is a 7 member, Governor-appointed Board, that hears appeals from decisions of the Secretary in contested cases or in cases that are subject to judicial review under certain provisions of the law.

The Board of Review is governed by Health-General Article, §§2-201 - 2-207, Annotated Code of Maryland and COMAR 10.01.05 Board Of Review Procedures.

Records Management

This office coordinates the DHMH Records Management Program.  This program ensures that all records are maintained, stored, and disposed of in accordance with applicable laws, regulations, guidelines and the Department's policy.

The Department's Records Management Program is required by State Government Article, §10-633, Annotated Code of Maryland, and the Department's process is outlined in DHMH Policy 02.10.02 Records Policy.
